Lease Renewal Fees
If the landlord has served a Section 25 Notice, the new rent will be quoted in the Notice. In these cases, we work on a performance basis with the fee charged being a percentage of the savings made between the landlord's quoting rent (as set out in the Section 25 Notice) and the finally agreed rent at renewal.
Where the landlord hasn't yet quoted or we instigate the renewal via a Section 26 Notice, we work on a time basis, calculated to the nearest quarter hour. All travelling, meetings and site inspections are charged at the same hourly rate.
Fees on a time basis are invoiced quarterly in arrears or at the resolution of the lease renewal, should that be earlier. Fees are exclusive of VAT and out of pocket expenses that typically cover the cost of survey documents and photographs.
The only additional fees payable are where the renewal is referred to the third party for determination. This is where the negotiations fail and the matter is referred to the Courts for determination or Professional Arbitration On Court Terms (PACT). There will be additional costs in the preparation of written submissions and possible oral hearings. We seek your prior approval before making additional charges.
Rent Review Fees
Again, these are charged on a performance basis with the fee charged being a percentage of the savings made between the landlord's quoting rent and the finally agreed rent at review.
The only additional fee payable is where the review is referred to the alternative dispute resolution service of the RICS (Arbitrator or Independent Expert) for determination. In no instance will such additional costs be incurred without your prior approval and knowledge.
Fees on a time basis are invoiced quarterly in arrears or at the resolution of the rent review should that be earlier. Fees are exclusive of VAT and out of pocket expenses that typically cover the cost of travel, photography and copying documentation.
